Terms of Service

Welcome to StyleCE. These Terms of Service ("Terms") govern your access to and use of the StyleCE application and website (collectively, the "Service"), operated by Anthony Fontana ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

StyleCE is a continuing education (CE) hour tracking tool designed for cosmetologists and licensed beauty professionals. The Service allows you to:

  • Log and organize CE course completions.
  • Track license expiration dates and renewal deadlines.
  • View state-specific CE requirements.
  • Receive renewal reminder notifications.
  • Upload and store CE completion certificates.
  • Export CE records (Pro plan).

2. Eligibility

You must be at least 16 years old to use the Service. By using StyleCE, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Paid Plans

4.1 Free Plan

The free plan includes tracking for one license, unlimited CE hour logging, expiration countdown, progress tracking, basic renewal reminders (30-day and 7-day), and access to state CE requirement data. The free plan is available indefinitely at no cost.

4.2 Pro Plan

The Pro plan is available at $4.99 per month or $39.99 per year and includes unlimited license tracking, an expanded reminder schedule, renewal checklists, CE category breakdowns, PDF and CSV export, cost tracking, and unlimited certificate storage.

4.3 Billing and Payment

  • All payments are processed securely through Stripe. We do not store your credit card information.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • Prices are listed in U.S. dollars and are subject to change with 30 days' notice.
  • You may cancel your subscription at any time from within the app. Cancellation takes effect at the end of the current billing period; you will retain Pro features until then.

4.4 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with the Pro plan, contact us within 14 days of your initial purchase or most recent renewal, and we will evaluate your request. Refunds, if approved, will be issued to the original payment method.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload content that is fraudulent, misleading, defamatory, or infringes on the rights of others.
  • Attempt to gain unauthorized access to other users' accounts or to the Service's systems and infrastructure.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use automated scripts, bots, or scraping tools to access the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Submit false CE records, fabricated certificates, or inaccurate license information.

6. User Content

6.1 Ownership

You retain ownership of all content you submit to the Service, including CE records, license information, and certificate images ("User Content"). We do not claim ownership of your User Content.

6.2 License Grant

By uploading User Content, you grant us a limited, non-exclusive, non-transferable license to store, process, and display your User Content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

6.3 Responsibility

You are solely responsible for the accuracy of the information you enter. StyleCE does not verify the validity of CE courses, certificates, or license information you provide.

7. Important Disclaimers

7.1 Not a Verification Service

StyleCE is a personal tracking and organizational tool. We are not a state board, a CE verification service, or an accredited CE provider. The Service does not verify, validate, or certify CE completions on your behalf. You remain responsible for ensuring compliance with your state board's requirements.

7.2 Not Legal or Professional Advice

State CE requirement data provided within the Service is for informational purposes only and may not reflect the most current regulations. Always verify requirements directly with your state board of cosmetology. We are not responsible for any consequences resulting from reliance on information provided by the Service.

7.3 Notification Reliability

While we make commercially reasonable efforts to deliver renewal reminders, push notifications and email delivery depend on third-party services and your device settings. We do not guarantee that every notification will be delivered. You remain responsible for monitoring your license expiration dates.

8. Intellectual Property

The Service, including its design, branding, logos, text, graphics, software, and all other materials (excluding User Content), is owned by StyleCE and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Account Termination

9.1 By You

You may delete your account at any time from within the app settings. Upon deletion, all your personal data, CE records, and uploaded certificates will be permanently removed from our systems within 30 days, in accordance with our Privacy Policy.

9.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before termination, except where immediate action is necessary to protect the Service or other users.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STYLECEU AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless StyleCE and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, with the arbitration conducted in the state of the operator's residence. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice within the app at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StyleCE regarding the Service and supersede all prior agreements, understandings, and communications.
